It’s well-known that the Americans With Disabilities Act (ADA) requires brick-and-mortar businesses be accessible to all patrons. This includes considerations like wheelchair accessibility and Braille or large print for blind and low-vision patrons, among other things. The ADA references “public accommodations,” and outlines 12 categories that essentially covers all types of public-facing businesses. However, the legislation does not address public-facing websites.

While the influx of the dot.com world eliminated the need for brick-and-mortar locations for all stores (think eBay or Amazon), all of the above categories typically had a headquarters, if not multiple locations where one could visit and interact.  This would ensure a unique experience, often depending on the individual needs of the visitor. For instance, when visiting a municipal building or institute of learning, a variety of methods are available to get to higher floors (stairs, elevators, ramps and escalators).
Another important consideration is that the ADA does not allow businesses to simply provide an alternative such as a phone number. Lastly, include accessibility issues as part of your website and mobile strategy. When new technologies are implemented or pages added, part of the process should include the implications for persons with disabilities. 
Government Code §11546.7 – The requirement that state agency heads certify, every two years, that their agency’s website meets the Web Content Accessibility Guidelines, Version 2.0 or a subsequent version, at Level AA or higher, and the requirements of Sections 11135 and 7405 of the Government Code. People with disabilities may interact with websites and online reservation systems differently than people not affected by disabilities. All types of disabilities need to be considered when setting up your website such as: visual impairments (blindness, low vision, color blindness), hearing impairments, physical disabilities, speech disabilities, cognitive disabilities, and multiple disabilities. Age-related disabilities such as arthritis, hearing loss, and vision loss should also be factored in when making your website ADA compliant.
As I mentioned above, under each WCAG 2.1 principle is a list of guidelines, and under each guideline are compliance standards, with techniques and failure examples at each level. Some guidelines include only Level A items; others include items for multiple levels of conformance, building from A to AAA. At each stage, you can easily see what more you would need to do to reach Level AA or AAA. In this way, many websites include elements at multiple levels of accessibility.

Develop a plan for making your existing web content accessible. Describe your plan on an accessible webpage, and encourage input on how accessibility can be improved. Let visitors to your website know about the standards or guidelines that you are using to make your website accessible. This is the reason why I think web design firms have to position themselves as solution providers and not just web guys/gals. A client doesn't need a website, they need sales. What’s the scope of the work? Will the website be basic with just a few pages about your company, its services, and contact information? Or will it also have an e-commerce section for online shopping, a blog, or content for visitors to download? Before you hire a web designer, make sure you have a thorough, specific list of the components you must have the designer include in the web design.

For Avanti Hotel to address the issue and make its website ADA compliant, it will cost around $3,000. However, oftentimes businesses must pay damages to the plaintiff on top of making the fix. In this particular case, the settlement is expected to be between $8,000-13,000. If the owner chooses to fight, damages plus lawyer fees could put him at more than $25,000.
